Acceptance of These Terms

By using this website or requesting services from Jenkins Mechanical, doing business as Jenkins Air Conditioning, you agree to these Terms of Service. If you do not agree, please do not use this website or request our services.

Services We Provide

We provide commercial and residential heating, ventilation, and air conditioning services, including installation, service, repair, and maintenance. We are licensed in the State of Texas under License TACLA28202E.

Descriptions of services on this website are provided for general information. The specific scope of work for your property will be defined in the estimate, proposal, or work order we provide to you.

Estimates and Pricing

Estimates are based on the conditions observed and the information available at the time they are prepared. If additional problems are discovered once work begins, or if conditions differ from what was originally described, we will notify you and obtain your approval before performing additional work.

Unless stated otherwise in writing, estimates are valid for 30 days. Diagnostic fees, after-hours rates, and emergency service rates may apply and will be communicated to you before work begins.

Scheduling, Access, and Cancellations

You agree to provide safe and reasonable access to the equipment and work areas at the scheduled time. If our technician cannot access the property or the equipment at the scheduled appointment, a trip charge may apply.

We ask that you notify us as far in advance as possible if you need to reschedule or cancel. We will do the same if circumstances such as weather or an emergency call require us to adjust your appointment.

Payment Terms

Payment is due upon completion of work unless other terms are agreed to in writing. For larger installations or commercial projects, a deposit or progress payment schedule may be required as set out in your proposal.

Past due balances may be subject to a late fee to the extent permitted by Texas law. You are responsible for any reasonable costs of collection on unpaid balances.

Warranties

Equipment we install is covered by the manufacturer warranty that accompanies it. Warranty terms, duration, and registration requirements are set by the manufacturer, not by us.

We separately warrant our workmanship for the period stated in your proposal or invoice. Our workmanship warranty does not cover damage caused by misuse, neglect, lack of recommended maintenance, alterations or repairs performed by others, power surges, water intrusion, pests, or other conditions outside our control.

Customer Responsibilities

  • Provide accurate information about the property, the equipment, and the issue you are experiencing.
  • Maintain the equipment as recommended, including regular filter changes.
  • Promptly notify us of any problem that appears related to work we performed.
  • Obtain any approvals required by a landlord, property owner, or association before authorizing work.

Limitation of Liability

To the maximum extent permitted by law, our total liability arising out of or relating to our services is limited to the amount you paid us for the specific service at issue. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost business, or property damage resulting from equipment failure that was not caused by our work.

Nothing in these terms limits liability that cannot be limited under applicable law.
